Information Privacy Notice: Sub Contractors

LR Lima Construction Ltd collects and processes personal data relating to its Sub Contractors. The Company is committed to being transparent about how it collects and uses that data in order to meet its data protection obligations.

What Personal Information does the Company Collect?

The company collects and processes a range of information from Sub Contractors. This includes:

- Name, address and contact details, including e-mail address and telephone number, date of birth and gender
- A photograph for identification purposes
- The terms of your Contract of Services
- Details of your relevant qualifications, skills and experience
- Information about your remuneration
- Details of your bank account and national insurance number
- Information about your emergency contacts
- Details of your availability
The Company may collect this information in a variety of ways. For example, data might be collected from your communication with your Project manager/Site manager etc., to provide services to the Company, from documents such as your ID or from forms completed at the start of your time providing services to the Company.

Data will be stored in a range of different places, including in the organization’s HR management system and in other IT systems (including the organization’s email system, shared drives and dedicated spreadsheets).

Whys does the Company process personal data?

The Company needs to process data to enter into a Contract of Services and to meet its obligations as outlined in any Contract of Services. For example, it needs to process your data in order to pay for your services.

In some cases, the Company needs to process data to ensure that it is complying with its legal obligations. For example, to deduct income tax and to comply with Health & Safety laws.

In other cases, the Company has a legitimate business interest in processing personal data before, during and after the end of your Contract of Services.

A legitimate Business Interest is where the Company believes it has a compelling business reason to process data as an aspect of fulfilling its business purpose. The processing is likely to be something that you would reasonably expect the Company to undertake. This can include processing data to allow the Company to:
Maintain accurate and up-to-date contact details (including details of who to contact in the event of an emergency) and records of statutory rights;

- Ensure that Sub-Contractors are receiving the correct payment to which they are entitled in line with their Contract of Services
- Meet its obligations under Health & Safety Law
- Manage the scheduling of Sub0Contractors
- Some special categories of personal data e.g., information about any disability you have advised the Company about

Who has access to data?

Your information may be shared internally, e.g. with HR, payroll, and other managers in the business to enable them to fulfill aspects of your Contract of Services. At times the Company shares tour time with third parties (The Guild), this may include third parties that process data on the Company’s behalf e.g. Payroll or Clients The company will not transfer your data to countries outside the European Economic Area.

How does the Company protect data?

The Company takes the security of data seriously and has internal policies and controls in place to aim to ensure that your data is not lost, accidentally destroyed, misused or disclosed and is not accessed except by individuals in the performance of their duties.

How long does the Company keep data?

The Company will hold your personal data for the duration of time you are providing services to LR Lima Construction Ltd.

The periods for which your data is held after your Contract of Services has ended varies dependent on content and can include current year plus a further 6 years.

Your Rights

As a data subject, you have several rights. You can:
- Access and obtain a copy of your data on request
- Require the Company to change incorrect or incomplete data
- Require the Company to delete or stop processing your data, for example
where the data is no longer necessary for the purposes of processing
- Object to the processing of your data where the Company is relying on its legitimate interests as the legal ground for processing.

What if you do not provide personal data?

You have some obligations under your Contract of Services to provide the Company with data in order to fulfill your Contract of Services.

Certain information, such as contact details and payment details have to be provided to enable the Company to enter into an arrangement with you if you do not provide the required information, this will hinder the organization’s ability to administer the rights and obligation as a result of the Contract of Services.
